Terms of Use

Volund provides a SaaS platform for creating, orchestrating and monitoring autonomous artificial intelligence agents for internal business use ("Service").

Use of the Service constitutes express and irrevocable acceptance of these Terms and our Privacy Policy. If you do not agree with any provision, stop using the platform immediately.

These Terms form the entire legal agreement between you and Volund and supersede any prior oral or written communication regarding the Service.

To use the Service, you must:

• Be at least 18 years old;
• Have full legal capacity to enter into contracts under Brazilian law;
• Use the platform exclusively for lawful purposes and in accordance with these Terms;
• If you represent a legal entity, have the authority to contract on its behalf.

Volund reserves the right to refuse or close accounts that do not meet the criteria above, at any time and without prior notice.

Registration requires true, complete and up-to-date information. You are fully responsible for keeping your credentials confidential and for all activity carried out under your account.

In case of unauthorized access or suspected compromise of your credentials, notify us immediately at legal@volund.com.br.

You may not share, sell, transfer or sublicense your account to third parties without Volund's prior written authorization. Volund is not liable for damages arising from unauthorized use of the User's account.

Organization accounts ("Orgs") may have multiple users. The Org admin is responsible for the conduct of all linked members.

The Service allows organizations to create and operate AI agents capable of performing tasks autonomously, integrating with external systems and processing data provided by the Users themselves.

Features include, without limitation:

• Creating and configuring agents with User-defined goals;
• Orchestration of multi-agent flows;
• Integration with third-party services and APIs;
• Custom knowledge bases;
• Monitoring, audit and analytics dashboards;
• Management of human approvals for sensitive actions.

Volund may, at its sole discretion, add, modify or discontinue features, with or without prior notice, without giving rise to any right to compensation.

The Service must be used exclusively for lawful and ethical purposes and in accordance with applicable Brazilian and international law. It is expressly prohibited to:

• Use the Service for illegal or fraudulent activities or activities that violate third-party rights;
• Create agents intended to generate disinformation, harmful content, spam or material that violates the law (including Law No. 12,965/2014, the Brazilian Internet Civil Framework);
• Reverse engineer, decompile or attempt to extract the platform's source code;
• Attempt to access, modify or compromise systems, networks or data of other users;
• Intentionally overload the Service's infrastructure (DDoS attacks, excessive scraping, etc.);
• Create agents that process third parties' personal data without an adequate legal basis under the LGPD;
• Use the AI models to generate content that violates third parties' copyright, image or privacy rights;
• Resell, sublicense or make access to the Service available to third parties without express authorization.

Volund reserves the right to suspend or close accounts that violate these rules, without prejudice to applicable legal action.

The Service may be offered under different plans, including free plans with limited features and paid plans with additional features. Prices, terms and billing periods will be shown on the plans page at the time of purchase.

All transactions are processed by certified payment platforms. Amounts are charged in advance and are non-refundable, except in the cases provided for in the Brazilian Consumer Protection Code (Law No. 8,078/1990) or by express agreement.

Volund may change plan prices with at least 30 (thirty) days' notice. Continued use after the new prices take effect constitutes agreement with the change.

The subscription can be canceled at any time directly on the platform. Access continues until the end of the period already paid for.

All intellectual property rights relating to the Volund OS platform (including source code, interfaces, trademarks, logos, documentation and methodologies) are owned exclusively by Beyond Cloud Consultoria em Tecnologia SA and are protected by Law No. 9,279/1996 (Industrial Property Law), Law No. 9,610/1998 (Copyright Law) and other applicable rules.

Volund grants the User a limited, non-exclusive, non-transferable and revocable license to access and use the Service in accordance with these Terms.

The User retains all rights to the data, content and results generated through their agents ("User Content"). By using the Service, the User grants Volund a non-exclusive, royalty-free, worldwide license to process, store and display that content solely to provide the Service.

Volund will not use User Content to train its own AI models without explicit consent.

The processing of personal data is fully described in our Privacy Policy, which is incorporated into these Terms by reference.

The User is responsible for ensuring that the data entered into the platform (including third parties' personal data used to configure agents) has an adequate legal basis under the Brazilian General Data Protection Law (Law No. 13,709/2018, LGPD).

For the purposes of the LGPD, the User acts as Controller of the data they enter into the platform, and Volund acts as Processor, processing that data solely according to the User's instructions and the terms of this agreement.

The Service uses third-party language models and AI systems. Results generated by agents may contain errors, inaccuracies or outdated information. The User is responsible for reviewing and validating any result before using it in relevant decisions.

Volund does not guarantee that agents will produce correct, complete or suitable results for specific purposes. Use of AI-generated outputs in critical contexts (medical, legal, financial, safety, etc.) is entirely the User's responsibility.

The User is solely responsible for the actions performed by agents created on the platform, including integrations with external services and automations with real-world effects.

The Service is provided "as is" and "as available". Volund makes no warranties of uninterrupted availability, freedom from errors or fitness for a particular purpose, except where expressly stipulated in a contractual SLA.

In no event will Volund be liable for indirect, incidental, special, punitive or consequential damages, including loss of revenue, lost profits, loss of data or business interruption, even if advised of the possibility of such damages.

Volund's total aggregate liability to the User, for any cause, is limited to the amount actually paid by the User to Volund in the 12 (twelve) months preceding the event that gave rise to the damage.

The limitations above do not apply in case of willful misconduct or gross negligence by Volund, nor do they exclude non-waivable consumer rights provided for in the CDC.

The User may close their account at any time through the platform or by email. After closure, data will be retained for the minimum period required by law and then deleted in accordance with the Privacy Policy.

Volund may suspend or terminate access, with or without prior notice, in case of: (i) violation of these Terms; (ii) non-payment; (iii) conduct that causes harm to the platform, other users or third parties; or (iv) legal requirement.

The clauses on intellectual property, limitation of liability, data and governing law survive account closure.

These Terms are governed exclusively by the laws of the Federative Republic of Brazil.

The courts of the district of São Paulo, SP are chosen as competent to settle any disputes arising from these Terms, with express waiver of any other, however privileged it may be.

Volund may update these Terms periodically. When there are material changes, we will notify active Users by email or a notice on the platform at least 15 (fifteen) days in advance.

Continued use of the Service after the new Terms take effect constitutes acceptance of the changes. If you do not agree, the User must close their account before the effective date.
